GENERAL TERMS OF SERVICE (ToS)

(1) Introduction

Thank you for using Envelope Delivery for Laziness (which will be known as “EDL”). By using our “Services”, you are deemed to be bond and agree with EDL’s General Terms of Service (ToS).

(2) “The Services”

EDL’s services is primarily for the members of QQ. However, any person with a valid pass to enter QQ Care Centre may use the service offered. EDL have the right to prohibit any person from using the services if found violating any of the ToS under Section 8.3 QQ rules Penal Code 8 Act 2021.

The users of EDL will be known as “you”, “your” or “users”.

The services offered by EDL are as follows:

(a) The process of shipping, handling or/and delivering shipments (which will be known as, but not limited to, envelopes, letters, parcels (boxes), or/and documents), from a specific location in QQ Care Centre to any location around the world.

(b) An insurance coverage if the shipments are broken or missing.

(c) The process of sending and documenting all QQ Care Centre’s commercial banks’ cheques issued by sender and send to banks safely.

(d) Products like miscellaneous.

(e) Cash-On-Delivery (which will be known as “COD”) Feature where businesses can collect cash upon delivery from its customers in QQ Care Centre.

(3) Prohibition of providing false information

When writing or typing into any forms or contracts provided by EDL, all users shall prepare the delivery correctly and provide all necessary details to enable EDL to perform the services. All users are liable to ensure that all the information provided to EDL is true and accurate.

Providing false information is an offense and punishable under QQ rules Penal Code 31 Act 2021. By using the services, you agree to NOT provide any false information to EDL.

(4) Prohibition when delivering shipments inside of QQ Care Centre

(a) All users are expected to use EDL’s services properly. EDL does NOT expect uncivil or unethical use of EDL’s service or its postbox, which includes but is not limited to the following: 

(i) scribble, doodle, decorate, damage or/and destroy EDL postbox.

(ii) paste any advertisements, propaganda posters, political advertisements or any picture on the EDL postbox.

(iii) use any of the EDL services if they do NOT follow or/and agree the ToS of EDL.

(iv) waste any of the spare items that were provided by EDL.

(v) move the EDL postbox from its original location.

(vi) shake, toss, throw, eject or/and remove any posted shipment in the EDL, regardless of the owner, receiver or/and sender of the posted shipment, for any reasons.

(vii) steal anything in the EDL postbox.

(viii) tear off any paper of the EDL postbox that was sticked officially by EDL.

(vx) send any shipment that are illegal or prohibited under the law of RULES OF QQ, international laws, or EDL’s statements/policies, which may include but not limited to illicit drugs, pornographic/sexual materials, dangerous weapons or/and ideology materials.

(b) Any person found doing the inappropriate actions stated in Section 4 (a) (i) – (viii) will be prosecuted under QQ rules Penal Code 8 Act 2021.

(5) Prohibition when delivery Malaysia shipments and international shipments 

(a) Users are PROHIBITED from sending the following shipments:

(i) Shipments that contain forgeries, unlicensed copies of products, counterfeits, live animals or plants, human or animal remains, narcotics or intoxicants, perishable goods, or goods requiring special handling, such as temperature or/and humidity control.

(ii) Shipments that contain controlled items and/or do not comply with any laws between countries that pass through or shipping with, violate any applicable trade laws or/and violate any law of the RULES OF QQ.

(iii) Shipments that contain items subject to any excise duties or special regulatory procedures or authorization for transport.

(iv) Shipments that contain items that are prohibited or is subject to special restrictions under the Universal Postal Convention and the supplementary documents, International Air Transport Association (IATA) or International Civil Aviation Organization (ICAO) rules; or contain goods that are classified as hazardous material, dangerous goods, prohibited or restricted articles by the European Agreement concerning the International Carriage of Dangerous Goods by Road (known as “ADR”) for Shipments carried by road, International Air Transport Association (or known as “IATA”) or/and International Civil Aviation Organization (or known as “ICAO”) for shipments carried by air, or other relevant organization.

(v) Shipment that has inadequate or defective packaging.

(vi) Shipment that contains materials which violates intellectual property rights, including forged, counterfeit or unlicensed copies of products (brand and trademark piracy).

(vii) Shipment that contains materials which may cause death or injury to or infection of persons or damage to property.

(viii) Shipment that contains expensive materials or items such as cash or other methods of payment, precious metals, works of art, jewelry, precious stones or other valuables or securities (unless otherwise agreed by EDL in its sole and absolute discretion).

(vx) Shipments that contains obscene or pornographic articles, posters or arts.

(b) Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY THE RULES OF QQ AND APPLICABLE LAWS, IN NO EVENT WILL EDL, THE SERVANTS OF THE AGENCIES OF QQ, THE ENTIRE AGENCIES OF QQ, ORGANIZATIONS OF QQ, AND MEMBERS OF QQ, HAVE DIRECT AND INDIRECT CONTACT WITH ANY LIABILITIES WITH USERS IN REGARD TO ALL SHIPMENTS SENT OUTSIDE OF QQ CARE CENTRE. USERS WILL BEAR FULL RESPONSIBILITY WITH THE GOVERNMENT AGENCY OF THE RESPECTIVE LAND, TERRITORY, STATE, COUNTRY OF SOVEREIGN POWER WITH THAT YOUR SHIPMENT IS INVOLVED, AND USERS SHALL SETTLE ALL DISPUTES AND APPEALS IN RELATION WITH THEM.

(6) Carriers that ship outside of QQ Care Centre

For shipments outside of QQ Care Centre, EDL will be using Pos Laju for all shipments inside of Malaysia, and DHL or FedEx for all shipments outside Malaysia. They do NOT have relation with this General ToS.

(a) By shipping with Pos Laju, you agree to their Terms and Conditions - General which can be found at https://www.pos.com.my/terms-and-conditions-general.

(b) By shipping with DHL, you agree to their GTCs which can be found at https://www.dhl.com/my-en/home/our-divisions/ecommerce/shipping/helpful-information.html.

(c) By shipping with FedEx, you agree to any of their applicable agreements at https://www.fedex.com/en-my/home.html.

EDL will collect additional quotation fees and service fees for helping to process shipments via carriers. Users will be quoted price for certain service that requires quotation. Users consent that EDL will fill in any applicable carrier forms on their behalf.

(7) Disclaimer of damage or loss

EDL and other carriers will make every reasonable effort to deliver the shipment according to EDL's regular delivery schedules and Standard Operating Procedures (SOPs), but these schedules and SOPs are not bind to the ToS. EDL is not liable for any damages or losses caused by any form of how.

Users agrees to indemnify EDL or other carriers, and its subsidiaries, and their respective directors, officers, employees, and agents from and against all actions, causes of action, liabilities, claims, suits, judgments, liens, awards, losses, and damages, suffered by reason of user’s failure to comply with the General ToS AND the extent of negligent acts or omissions by EDL and other carriers.

EDL and other carriers are NOT liable for any loss or damage arising out of circumstances beyond EDL and other carriers' control. These include, but are not limited to, electrical or magnetic damage to, or erasure of, electronic or photographic images, data or recordings; any defect or characteristic related to the nature of the shipment, even if known to EDL or other carriers; any act or omission by a person not employed or contracted by EDL or other carriers, e.g. Sender, Consignee, third party, customs or other government official; “Force Majeure” - e.g. earthquake, cyclone, hurricane, storm, flood, fog, radiation contamination, pandemic, war, plane crash or embargo, riot or civil commotion, any information security-related threats including cyberattacks, “cyber-attacks” shall include, without limitation, (distributed) denial-of-service attacks or any form of computer code whether known or unknown, including “electronic possession”, “logic bombs” “viruses”, ”ransomware”, “Trojan horses”, “worms”, “spyware”, “malware”, “drop dead device”, and “adware”, which could, in any way, disable, disrupt, harm, impede or modify the performance or functionality of all or any part of any system, program, equipment, network or data, industrial action or disputes.

(8) Google® services

Most of EDL's online services are powered by Google®. Google® are both a product, service and property of Google Inc. in the United States.

By using any of EDL's online services, you agree to the Terms of Service of Google Inc. which can be found at https://policies.google.com/terms.

(9) Insurance

Insurance can be purchased by the user as part of the shipping process and are optional. To learn more about insurance, how to purchase, how to file a claim, and upcoming updates about it, visit https://edl.qq.thegwk.tk/extra-service/insurance.

By purchasing any insurance plans offered by EDL, you deemed to agree that EDL has the FULL RIGHTS to VOID any incoming or pending insurance request at any time due to any reasonable reason with or without any prior notice.

(10) COD Feature

The COD Feature is a feature where the receiver would need to pay a certain amount of money in cash set by the sender (Example: the item value) at the receiver's location to EDL. Then, EDL will take a small percentage of the amount as processing fee. The rest of the money will be sent to the sender via cash or bank account.

By using the COD feature, the receiver agrees to pay the total item value amount of money in cash set by the sender to get the shipment. Otherwise, the receiver will NOT receive it and shall be sent back to the post office of EDL or back to the sender. Additional charges will apply to send back to the sender.

By using the COD feature, the sender agrees that there will be charges when using the COD Feature. Instructions on how to use the feature and service fee options can be found in EDL’s portal website at https://edl.qq.thegwk.tk.

(11) Data collected when using online services

When you use our online services, specifically EDL’s portal web which was powered by Google Sites, EDL DO NOT collect your browsing data or cookies. These data may be collected by Google Sites. You can review their Privacy Policy at https://policies.google.com/privacy.

EDL only collects data when you submit any kind of forms.

For California residence in the U.S., Californian Consumer Privacy Act (CCPA) rights do NOT apply with EDL because EDL is NOT a public company. Under the Act, EDL don't make a profit of more than TWENTY-FIVE MILLION UNITED STATES DOLLAR (US$25,000,000.00). EDL services are NOT meant for anyone in the public. Any opt-out of data, 'unsell’ your personal information or give you the data that we collect is impossible. Once you send any form or data to us, WE DO NOT OPT-OUT OR DELETE YOUR DATA EVEN IF IT IS CONFIDENTAL, PRIVATE OR URGENT INFORMATION. Users are urged to be responsible next time when sending data.

(12) Governing Rules

This General ToS that are in relation between you (as a user) and EDL are governed under the laws of QQ Care Centre. The RULES OF QQ will apply to ALL matters regarding the use of service offered by EDL. 

All disputes and appeals MUST be sent to jurisdiction of the court of Hammer of Justice (HOJ).

(13) Additional Agreements

Partial of EDL's portal website's photo uses Artificial Intelligence (AI) to generate. The software EDL use is Nano Banana Pro by Google Gemini. By using our services, you understand and accept that partial of the photo content in this portal website is generated by AI. All text content remains context generated by authentic EDL agent or agencies of QQ.
